Kennel code to be considered
HOWELL - At its meeting on Oct. 16 the Township Council is expected to consider the passage of an ordinance that establishes guidelines and acceptable locations for dog kennels; revises the definition of dog kennels; and limits the number of dogs per household in all zones.
The stated goals of the ordinance are to "protect residential land from potential adverse impacts of dog kennels; encourage dog kennels to be located on adequate sized properties in areas of the township and to locate them in appropriate zones and at appropriate distances from each other; protect dogs by regulating the number of dogs allowed on a particular piece of property to ensure adequate open space for exercise, provisions for pet solid waste removal and disposal."
And, "to recognize that dogs are not livestock within the meaning of Howell's agricultural use definition and to prevent possible nuisance effects of the ownership and maintenance of too many dogs at any single place, whether that place be located in Howell's ARE (agricultural-residential) zones or other residential zones."
The ordinance states that dog kennels will be a permitted conditional use in the ARE-3, ARE-6 and SED (special economic development) zones on lots with a minimum size of 3 acres.
In regard to the number of dogs permitted to be kept at a residence, the ordinance explicitly states that it will be unlawful for a property owner "to keep or maintain more than five dogs of the age of 7 months or more or of an age which said dogs possess a set of permanent teeth, whichever is earlier, on any premises which contain a single dwelling or dwelling unit, or any single commercial, industrial or other property other than a kennel, pound or pet shop."
